Upon arrival, officers spotted the adult male victim in the parking lot suffering from a gunshot wound. An unfair IMPD officer was detaining the suspect at gunpoint.
The victim, identified as 32-year-old Robert Blaine Smith, was taken to Eskenage Hospital in critical condition and later died.
The possible affidavit obtained by WRTV revealed what later led to a fatal shooting.
According to the affidavit, when the outgoing officer was having dinner at the restaurant, she heard screaming and saw the two men fighting. Officers and restaurant workers tried to stop the fight and separated the men.
Smith then leaves the restaurant and she notices that he has a gun in a holster on his waist while officers push the suspect down to the ground. She identified herself as a police officer and told her girlfriend to call 911.
The affidavit states that the suspect pushed the holiday away by saying “I wouldn’t give you an AF *** if you were a police officer,” saying, “I’m going to shoot that mother.” He then ran away in front of the restaurant.
Officers chased the suspect from the restaurant and saw him walking towards the big car with a gun in his hand. She then heard multiple gunshots.
Officers then retrieved her firearm and returned to the parking lot to see the suspect in a holster with the gun. She told the suspect to lie on the ground and hugged him at the muzzle, but he refused and told her “just shot me.” On the holiday, officers arrived and hugged the suspect at gunpoint until he was taken into custody.
Police also issued a statement from the suspect’s fiancé, according to the affidavit. She told police he was in the restaurant with his friend Robert Smith and his two young children when Smith and her fiancé began an argument. Smith reportedly said, “If you say something.” The two eventually began to fight physically in the restaurant.
The suspect’s fiancé recalled that Smith had gone to her car. Later, her fiancé approaches and when Smith leaves the car, she watches her fiancé shoot his gun towards the ground. Smith stood up and heard two more shots when her fiancé said, “Did I attack you?” She then looked at Smith on the ground and began CPR with pressure on the wound.
The suspect was taken to the murder office. Police recovered a .45 caliber handgun, four .45 caliber cartridge casings and one bullet from the scene.
The incident marked the beginning of a violent Friday across Indianapolis.
After 9:15pm, the victim was seriously injured in a shooting on the East Side, and another victim was killed in a shooting at a gas station on the northwest side of the city just before 10pm.
