Austin – Attorney General Ken Paxton successfully blocked the Centers for Medicare and Medicaid Services (“CMS”) rules adopted by the Biden administration, which attempts to rewrite federal law, enforce expensive and troublesome regulations on nursing homes, and threatens to enforce many Texas facilities.

“This is a huge victory for Texans who rely on nursing homes for care, and ensure that they don’t have to close their facilities due to Biden’s burdensome regulations. The Biden administration’s lawless legacy will eradicate one victory after the next victory. “I have sued Biden more than 100 times and will continue to fight aggressively to prevent the arbitrary, illegal dict orders issued by his deep state officials from being enacted.”

In 2024, Attorney General Paxton sued the Biden administration, shutting down many rural nursing homes and suing CMS rules that could have expelled elderly citizens, including those living in memory care facilities. Despite not having the authority to do so, the Biden administration has sought to arbitrarily decide on changes to federal law. Now, federal judges are granting Attorney General Paxton’s request to vacate illegal rules.
