Judge denys DOJ motion to move Khan Suri’s case to Texas – Hoya

Tolliver Giles questioned the government’s argument that Virginia’s detention centers were overcrowded, highlighting that government lawyers originally cited potential overcrowds, but later justified the relocation of Khan Sri due to insufficient bed space for Khan Sri. At the Texas Detention Center, the court application explains that Khan Suri has been detained in a dorm with at least 50 people, exceeding the capacity of 36, meaning that he had to sleep in a plastic bed for two weeks.

The ruling does not outline the circumstances of Khan Suri’s other petitions, but transferring his case may mean his return to Virginia.

“I am celebrating the news that I just came from a judge in Alexandria, Virginia,” Hashemi told hoya. “It is a step in the right direction in terms of justice of Badar Khan Suri and his rights and recovery from the suffering that his family has endured since March 17th. I hope this will lead to his release and he will be able to return home as soon as possible.”

Tolliver Giles said that moving the case to Texas would deprive Khan Suri of access to his family and legal representation.

“It’s not a forum shopping exercise for petitioners to file and review his habeas corps in this district. It’s the jurisdiction in which he lives, was arrested and originally detained,” writes Tolliver Giles. “Instead, they will force petitioners to litigate his case in Louisiana or Texas, and on that matter many states away from his lawyers and family will meaningfully deprive them of their ability to support his representatives during these popular procedures.”

If the lawsuit continues in Texas, Khan Sri and the government could argue before Court of Appeals for the 5th Circuit Considered The most conservative court of appeals in the country.

Hashemi said that Virginia and Washington, DC judges could be more open-minded than Texas judges, indicating an improvement in the likelihood of Khansari’s release of litigation jurisdiction in Virginia.

“Judge Giles, who ruled today in Alexandria, Virginia, was appointed by the Biden administration,” Hashemi said. “Judges in the DC area tend to be much more open-minded in how they adjudicate these cases. This is part of a deliberate plan.”

“This simply shows just how ideologically extreme and punitive the Trump administration is when it comes to arresting these innocent people,” Hashemmi added.
