During the investigation, authorities learned Toribio-Martinez was a frequent visitor to the Round Rock area, and on Wednesday he was caught trying to hide from authorities by hiding under a couch at an apartment complex.
Toribio-Martinez was taken away and booked into the Williamson County Jail.
Background to this incident
(Warning: some readers may find the following details disturbing.)
According to an affidavit obtained by KVUE, Toribio-Martinez was under investigation by Austin police in January after they received a call from a woman who believed her 5-year-old daughter had been raped by her stepfather.
The woman alleged that she found scratches on her daughter’s neck and asked her where she came from, but she did not respond. The woman then asked the suspect, later identified as Toribio Martinez, to leave the room. He did not leave until the woman physically pushed him away, she told police.
The 5-year-old girl allegedly claimed her stepfather had removed her pants, engaged in inappropriate behaviour and then stolen her underwear. Toribio Martinez left the home after the woman called police.
When authorities examined the 5-year-old girl for injuries, they found multiple bruises on her neck. The girl also identified Toribio-Martinez as the suspect and claimed she was told not to tell her mother.
During interviews with authorities, the 5-year-old girl alleged that Toribio-Martinez had exposed himself to her before engaging in inappropriate acts. Her mother tried to contact the man but did not receive a response.
