Detectives recovered the smartphone, which was found with its flashlight function turned on, and zeroed in on the possible suspect. Avila was taken into custody at the Westlake Gardens Apartment Complex on Robbins Drive, where officers believe he was searching for his lost cell phone. A search warrant executed at an apartment associated with Avila uncovered items taken from the victim as well as evidence linking him to the crime.
Additional evidence found may be related to two other felonies, and further charges are expected as the investigation continues. Avila was charged with burglary with intent to commit another felony, a first-degree felony, and remains in custody at the White Settlement Police Department. The department is working with the Tarrant County Criminal District Attorney’s Office to investigate appropriate charges.
“I would like to thank our investigation, patrol and dispatch teams for their quick and decisive actions today which resulted in the arrest of this dangerous suspect within hours of the incident,” said Police Chief Christopher Cook. said. “Bringing justice to this victim and restoring safety to our community is always our top priority.” The victim has been released from the hospital and is with family.
