LUBBOCK, Texas (TNND) — Texas Attorney General Ken Paxton announced Sunday that he will file a lawsuit against the National Collegiate Athletic Association over its policy allowing transgender women to participate in women’s athletics.
The complaint alleges that the NCAA engaged in deceptive business practices by promoting women’s sporting events that were actually “coedified sporting events in which men could compete against women.”
“Consumers purchase products and services related to women’s college sports because they enjoy watching women compete against women, rather than men competing against women,” the complaint states. It’s dark. “Consumers buy these products to support women’s empowerment and fair competition among women.”
Paxton’s lawsuit asks Lubbock County to issue a preliminary injunction preventing the NCAA from allowing biological males to compete in women’s track and field, citing the physical advantages biological males enjoy. I’m asking the district court.
“Many consumers would be reluctant to purchase products or services associated with NCAA women’s sporting events if they knew that female athletes would be exposed to unreasonable safety risks by competing against biological males. It will not,” the lawsuit alleges.
NCAA Director of Communications Michel Bruttlag-Hossick issued a statement to the National News Desk saying the NCAA “does not comment on pending litigation.”
“The (NCAA) and its members will continue to advance Title IX, make unprecedented investments in women’s sports, and ensure fair competition in all NCAA championships,” Hosick wrote.
The lawsuit follows a similar lawsuit against the Mountain West Conference, an NCAA-sanctioned sports organization. Several women’s volleyball players filed a lawsuit against the conference in November over transgender players on San Jose State’s women’s volleyball team.
U.S. District Judge S. Kato Cruz argued in late November that the San Jose State team had not shown how transgender athletes playing on the team would cause “irreparable harm” to the players. A motion for a preliminary injunction filed by female volleyball players was dismissed.
The inclusion of biological males on women’s sports teams has become a politically charged topic. Rep. Seth Moulton, D-Mass., said Democrats need to reevaluate their stance on the issue immediately after the 2024 presidential election.
“Democrats are far too focused on trying not to offend anyone, rather than being brutally honest about the challenges facing many Americans,” Congressman Moulton told the New York Times. I’m spending too much time. I have two little girls and I don’t want them to run over me.” It’s normal for men, or former male athletes, to speak out on the field, but as a Democrat, I should be afraid to say that.”
The comments drew strong criticism from Moulton from LGBT advocacy groups, and a protest erupted outside Moulton’s office in Salem, Massachusetts.
Meanwhile, Republicans are doubling down on their pledge to keep women’s sports fair. President-elect Donald Trump on Sunday vowed to eliminate transgender “insaneness” from American schools once his new administration takes office on January 20.
